    Sorteer Inc., a Delaware corporation, (“Sorteer”) is committed to protecting its users’ privacy. This Privacy Policy is designed to inform users of the www.Sorteer.com website (“Website”) about how Sorteer gathers and uses information provided to, or collected by, Sorteer and under what circumstances Sorteer will disclose such information. Sorteer will take reasonable steps to protect user privacy consistent within the guidelines set forth in this Privacy Policy and with the laws of the United States.

    By accessing the Website, you agree to comply with and be bound by the terms and conditions of the Website.

    Our Website may provide links to other websites for your convenience and information. We do not control these sites or their privacy policy as they may operate independently from us. Linked sites may have their own privacy notices or policies, which we strongly encourage you to review if you visit any linked websites. To the extent any linked websites you visit are not owned or controlled by us, we are not responsible for the sites’ content, any use of the sites, or the privacy practices of the sites. Some third-party companies may choose to share their personal data with us; that sharing is governed by that third-party company’s privacy policy.

    What Information Do We Collect?

    Member Information You Provide: Sorteer collects information for the purpose of providing you with a satisfactory user experience on the Website, providing you a personalized experience on our Website based upon your history on the Website, and assisting you in purchasing events listed on the Website (“Events”) from listings created by Organizers who provide Events (“Organizers”). This information may include our customers’ (“Members’”) personally identifiable information (“Personal Information”), including but not limited to, our Members’ name, username and password, mailing address, telephone number, e-mail address, location (based on IP address or as set by the Member) and credit card information. If you consider purchasing an Event from Sorteer for another person or persons (“Guests”), Sorteer may collect the same information about your Guests in order to facilitate your Guests’ interactions with us and Organizers. The Guest(s) may contact us to request removal of their information from our database by using our contact information below. The information may be collected when you register with the Website, when you register for an Event, when you subscribe to receive e‐mails and/or e‐newsletters from Sorteer, and/or when you register with any Organizer. Once you register as a Member with Sorteer and/or one or more of Organizers, you are no longer anonymous to us. Additionally, we collect clickstream data, which becomes part of your Member information.

    Facebook and Other Third Party Connections: You can connect your Sorteer account to your accounts on third party services, such as, Facebook, in which case we may collect, use, disclose, transfer and store information relating to your account with such third party services in accordance with this Privacy Policy. Facebook may ask your permission to share certain information from your Facebook account with the Website. For example, if you connect with Facebook, we store your Facebook id, first name, last name, email, location, friends list and profile picture, a link to your Facebook profile, likes and other data that is part of your or your friends’ Facebook profile (s)and may use them to connect with your Facebook account to provide certain functionality on the services, for example, recommending Events that your Facebook friends are interested in and sharing the events you are interested in with certain groups of people, such as, your Facebook friends who are also on Sorteer. You can control the information that we receive from Facebook using the privacy policy setting in your Facebook account.

    Cookies: Our Website, similar to many many websites on the Internet, uses “cookies.” A cookie is a small text file automatically placed on your computer’s web browser that is used to recognize users who have previously visited the Website. In general, these cookies are either persistent and may reside on your computer for several months or longer after you last accessed the Website (unless you delete or otherwise dispose of them), or they may be more temporary in nature. Our Website generally uses persistent cookies but may also use temporary cookies called “session cookies,” which are stored for a single user session on the Website and are deleted as soon as the user’s browser is shut down.

    We use cookies for purposes that include, but are not limited to, keeping track of your purchases and other activities on the Website, delivering content specific to your interests, saving your password, and if you choose, saving other personal and financial information so you do not have to re-enter it each time you visit the Website. We do this to enhance your experience on our Website and to make it as easy to use as possible. Our cookies also do not, by themselves, contain Personal Information, and we do not combine the general information collected through cookies with other Personal Information to tell us who you are.

    Please note that Sorteer does not collect data on any websites other than the Website, however, Braintree does provide an electronic confirmation of each purchase to Sorteer. Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways.

    Web Beacons: Sorteer may also use electronic images known as “web beacons” (or “clear GIFs”) that allow us to track general user traffic patterns. Sorteer also automatically receives and records information from our servers and from your browser, including your IP address, the time, and information about any page you requested. Sorteer may also include web beacons in promotional or other e-mails or e-newsletters to determine whether Members have acted upon these messages. The information obtained in this manner enables Sorteer to customize services we offer our Members, to deliver targeted advertisements and to measure the effectiveness of our on-line advertising and marketing activities.

    Third Party Clickstream Data: When you purchase an Event, depending on the payment method you choose, you may be transferred to the website of our third party payment agent. As noted above, this policy does not apply to third party websites. You should read the privacy policy associated with the third party payment agent’s website to understand what information about you it collects and how such information is used. We do not control when or how third parties place cookies on your computer. For example, third party websites to which a link points may place cookies on your computer. If you visit the website of one or more Organizers, the Organizers may place their own cookies on your computer in order to serve you with relevant advertising online. This third party cookie may transfer non-personally identifiable information to the third party partners in order for them to track your activity when you visit their websites and on other websites not controlled by Sorteer for purposes of serving you ads on topics in which you have a demonstrated interest based on your Clickstream Data. Please note that we can only access Cookies that we set on your computer, not the Cookies sent to you by other companies. Also, when you leave the Website, whether by clicking on third party sponsored content or advertising or directly accessing a third party’s website, these third parties may place cookies or web beacons on your computer. This Privacy Policy does not govern the use and disclosure of any information collected by third parties, such as through cookies or web beacons, when you visit their web sites or by third parties regarding your clickstream activity on sites other than the Website.

    In full disclosure, we partner with a third party ad network to either display advertising on our Website or to manage our advertising on other sites. Our ad network partner uses cookies and web beacons to collect non-personally identifiable information about your activities on our Website and other websites to provide you targeted advertising based upon your interests. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by contacting us at legal@sorteer.com. Please note this does not opt you out of being served advertising. You will continue to receive generic ads.

    Widgets: The Website includes “Widgets”, interactive mini-programs running on our Website to provide services from another company. Personally identifiable information (e.g., e-mail address) may be collected through the widget. Additionally, Cookies, web beacons and other Clickstream Data may also be set by the Widget. The use of any information collected through a Widget is governed by the privacy policy of the company that is responsible for the content received through the Widget. We recommend you read the privacy policy of any content provider you encounter through the use of a Widget to understand how that content provider gathers and uses information it collects.

    Supplementary Information: Sorteer may supplement Member Information with information about a Member that is publicly available or that is made available by third parties through paid subscriptions. For example, if a Member provides the name of the company for whom that Member works, we may obtain information showing the number of employees and estimated annual turnover for that company. This information is called “Supplementary Information” and, once added to Member Information, is deemed to be Member Information.

    Our Use and Disclosure of Information We Collect.

    Our Use: We may provide your Personal Information to companies that provide services to help us with our business activities. Sorteer may use personally identifiable information we gather in the normal course of our business, including, to improve the content of our Website, to customize the content of our Website to our Members, to notify Members about updates to the Website, to contact Members for marketing purposes, and to respond to any request Members may have regarding a listed Event or other customer service issues. The information we collect during the registration process, or otherwise, may be used to manage the Member relationship, to customize our product offerings, and to provide information about new products and/or special offers to Members. Also, information collected may be used by us, Organizers and other Sorteer partners, as necessary, to book, schedule, facilitate, confirm and otherwise enhance your Events with Organizers.

    Organizers: We may provide personally identifiable information to Organizers. This may be necessary to purchase, schedule and provide the Events. Sorteer has no control over the further use of your personally identifiable or other information or the sharing of such information by Organizers. Once again we strongly recommend that you carefully review the privacy policy of any Organizer, other Sorteer partners and the third party payment agent before providing personal data. We allow Organizers to contact Buyers by email for their current and past events, so you may receive emails from our system or directly from Organizers.

    Paying Agents: If you book or purchase an Event, we will permit you to click through to the third party payment agent, which will require your credit card or other account information with which Members will pay for the Event. We will, if necessary, provide information to our payment processing vendors in order to process credit card payments and perform related payment functions. We do not give out your credit card or other account information to unaffiliated third parties, unless you authorize us to do so or if it is necessary to fulfill our responsibilities, including, but not limited to, providing an Event.

    Sorteer does not store your credit card or other account information.

    Legal Requirements: Sorteer may disclose any and all information collected if, in reasonable good faith, it believes it is required to do so to comply with any local, state, federal or foreign law, to respond to a court order, any court or governmental subpoena (or its equivalent), or any domestic or foreign governmental investigation. We also reserve the right to disclose information collected that we believe, in reasonable good faith, is appropriate or necessary to protect against any liability; to protect Members from fraudulent, abusive or unlawful uses; to investigate and defend Sorteer against any third party claims or allegations of wrongdoing; to respond to users’ support requests; to assist domestic or foreign government enforcement agencies; to protect against fraudulent uses the rights, property (including intellectual property) or safety of Sorteer, its Members, Organizers, users of the Website or other persons or entities.

    Merger or Sale of Sorteer: In the event Sorteer Inc. is acquired by, merged with or into, or substantially all of its assets are sold to a third party entity, Sorteer reserves the right to transfer or assign the information it has collected from users of this Website as part of such acquisition, merger or sale. Sorteer does not sell your personally identifiable information to third parties not involved in the selling, booking, paying, providing or facilitating Events.

    How Can You Opt-Out of Use and Disclosure of Your Information?

    Sorteer will only use your information for the purposes described in this Privacy Policy or as subsequently authorized by you in writing. Sorteer operates on the basis that Members can request information regarding Organizers and purchase and/or book Events. If you do not want your information disclosed in this way, you must NOT purchase an Event and request NOT to be contacted by an Organizer.

    If you do not wish to participate in market research surveys, simply opt-out of any survey email you receive.

    Following the registration process, we also allow Members the option to opt-out of receiving emails from Sorteer. Members who opt-in may also remove themselves from emailing lists at any time through the edit profile pages or by following the instructions at the end of any email they received from Sorteer.

    If you do not want to receive future communications from Sorteer, please contact us at team@sorteer.com and we will deactivate your membership.

    How We Protect Personal Information

    The security of your Personal Information is important to us. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

    However, unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time. We maintain appropriate administrative, technical and physical safeguards designed to protect the Personal Information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We do not guarantee or warrant that such techniques will prevent unauthorized access to information about you that we store, whether Personal Information or otherwise. In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate or required by law, we would endeavor to do so as promptly as possible under the circumstances.     Children’s Privacy

    The Website is not directed at children, and we do not knowingly collect Personal Information from children under the age of thirteen (13).

    If you are a child under the age of thirteen (13), you are not permitted to use the service available on the Website and should not send any information about yourself to us through our services. In the event that we become aware that we have collected Personal Information from any child, we will dispose of that information, or otherwise treat it, in accordance with the Children’s Online Privacy Protection Act (“COPPA”) without such parental consent.

    This Website is not intended for the use of any one under the age of eighteen.

    Although it is possible that certain Events presented on this Website may be intended for children under the age of eighteen as well as adults, it is our expectation that such Events will be purchased by adults who intend to attend the Event with such children. Parents should be aware that this Privacy Policy will govern our use of Personal Information, but information that is voluntarily given by children — or others — in chat sessions, e-mail exchanges, bulletin boards or the like may be used by other parties to generate unsolicited communications. We encourage all parents to instruct their children in the safe and responsible use of their personal data while using the internet

    International Privacy Laws:

    The Website is operated in the United States. If you are visiting our website or using one of our software applications from outside the United States, please be aware that you are sending information (including personal data) to the United States where our servers are located.     We will retain your information for as long as your account is active or as needed to provide you services. Please contact us if you wish to cancel your account or request that we no longer use your information to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

    Registration Password: Your Member information is password-protected to control access to this profile information by third parties. We recommend that you do not divulge your password to anyone. Sorteer will never ask for passwords in unsolicited phone calls or unsolicited emails.

    Links: The Website contains links to other websites, particularly the third party paying agents’ websites. Sorteer is not responsible for the privacy practices or the content of those sites. You should be aware of this when you leave our Website. Please review the privacy statements of each website you visit that collects information. This Privacy Policy applies solely to information collected by the Website.

    Options: Users who would rather not provide any of the user data requested by our registration process do not need to register with us. You can still view much of the content and use many of the services offered by our Website without registering; however, if you choose not register as a member you will not be able to purchase or book an Event.

A user is bound by any changes to the Privacy Policy when he or she uses the services after notice of such changes has been given.
